My Lord,
I have the honour to report that a suggestion
has been made by the Auditor that poundage should be levied
on all monies paid into the Supreme Court of this Colony or
at any rate on all monies paid in under order of the Court.
The majority of the cases in which orders of this nature
are made are money-lenders' actions and it seems only
reasonable that some special remuneration, proportionate to
the amount collected, should be secured for the accounting
and other work involved in these troublesome collections.
2.
It is understood that a system of poundage
exists in some of the English Courts and possibly in other Colonial Courts and I shall be glad, therefore, if I might
be furnished with copies of the rules under which such
Courts make this levy and any other information bearing on
the subject which may be available. It is particularly
desired to know whether such levies extend to sums paid
voluntarily into Court by litigants.
